Key takeaways
- Descriptive or generic marks are refused for lack of distinctiveness.
- A mark similar to an earlier one for related goods or services is refused.
- MoET fees are per class: AED 750 to apply, AED 750 publication and AED 5,000 registration.
- Foreign applicants file through a listed trademark agent with a notarised power of attorney.
- Marks last 10 years from filing; renewal is possible up to six months late, at a higher fee.
The mistakes behind most refusals
| Mistake | Why it fails | Fix |
|---|---|---|
| A descriptive name, like 'Best Coffee' for coffee | Not distinctive | Use an invented or unusual word |
| Too close to an earlier mark | Conflicts with earlier rights | Search first; choose a distinct name |
| Using a flag, emblem or official symbol | Prohibited by the trademark law | Remove official symbols |
| A misleading place name | Could mislead about origin | Avoid places you don't come from |
| Someone else's name or image | Needs their consent | Get written consent or remove it |
| Words like 'registered' or 'copyright' | Prohibited terms | Remove them |
Filing mistakes
- Wrong classes. Each class has its own fees; filing in every class wastes money, too few leaves gaps.
- Combined mark only. A name-plus-logo mark protects that combination; if you redesign, the registration may no longer match. See logo or word mark.
- Missing power of attorney. Foreign companies and individuals file through a trademark agent listed in MoET's register, with a notarised power of attorney.
- No search. Read our trademark search guide before filing.
After filing: deadlines people miss
- Publication and objections. After acceptance, the mark is published and anyone can object within 30 days.
- Registration fee. The mark is registered once the registration fee is paid.
- Renewal. Protection lasts 10 years from filing. MoET accepts renewal up to six months after expiry at a higher fee; after that the mark is cancelled.
- Non-use. A mark left unused for a long continuous period can be cancelled at someone else's request.
If your mark is refused
A refusal isn't always final. The law lets an applicant challenge a refusal before a Grievances Committee and then in court. A narrower list of goods or services, or an amendment MoET suggests, sometimes solves it. For disputes needing legal argument, instruct a licensed advocate.
